On legal aspects regulating the activities of museums
1. Museums are cultural organizations established for the storage, protection, preservation, study and public presentation of museum objects and museum collections, designed to carry out cultural, educational, research functions and ensure the popularization of the historical and cultural heritage of the Republic of Kazakhstan.
2. Museums of various profiles can be created on the territory of the Republic of Kazakhstan, including museums-reserves and museums of private collections.
3. Museum objects and museum collections are included in the museum fund and are an integral part of the cultural heritage of the people of the Republic of Kazakhstan.
The acquisition of museum funds is carried out on the basis of decisions of the stock procurement (stock selection) commissions established in state museums, in accordance with the procedure determined by the authorized body.
The State Catalog of the Museum Fund of the Republic of Kazakhstan is maintained by the National Museum of the Republic of Kazakhstan.
It is prohibited to transfer museum objects and museum collections from State museums to private ownership.
3-1. The examination of museum objects and museum collections made of precious metals and precious stones is carried out on a reimbursable basis by authorized organizations in accordance with the legislation of the Republic of Kazakhstan in the field of precious metals and precious stones.
4. State museums and nature reserves established in the organizational and legal form of a state institution have the right to provide paid activities for the sale of goods (works, services) that are not related to their main activity, the payment for which is not mandatory and is determined by agreement with an individual or legal entity.
The money from the sale of such goods (works, services) is used in accordance with the budget legislation of the Republic of Kazakhstan.
5. State museums and nature reserves established in the organizational and legal form of a state institution have the right to:
1) making copies from all types of media, formats, standards and their processing;
2) provision of Internet services on the basis of an agreement with a telecom operator;
3) taking photos and videos;
4) sale of souvenir and printing products;
5) the implementation of educational and methodological publications and other literature published by museums and nature reserves;
6) processing the materials of the museum fund and (or) compiling information and certificates about museum objects and museum collections, as well as objects and collections that are privately owned.
5-1. The right of the first publication on museum objects and museum collections included in the museum fund belongs to the museum, to which these museum objects and museum collections are assigned.
6. The procedure and conditions of access to museum objects and museum collections located in the museum’s storage, and other relations in the field of museum business are regulated in accordance with the procedure determined by the authorized body.
7.In order to ensure the storage of cultural values, subsidies are allocated from the state budget to state museums to cover losses related to ensuring the protection, preservation, accounting, acquisition and restoration of cultural values, in accordance with the procedure established by the budget legislation of the Republic of Kazakhstan.
